McCLENDON, J.
In this case, the plaintiffs appeal a trial court judgment, which granted in part and denied in part the motion for summary judgment filed by the defendant uninsured motorist carrier. For the reasons that follow, we maintain the appeal and affirm the judgment of the trial court.
