The defendant, Marcus Joel Smith, was convicted of attempted armed robbery, pursuant to La. R.S. 14:27 and 14:64. Smith was sentenced to 40 years at hard labor, with credit for time served. He filed this appeal, arguing that his sentence is constitutionally excessive. For the following reasons, we affirm the conviction and sentence.
