A unanimous jury convicted Defendant Robert J. Moody as charged of forcible rape. The trial court sentenced him as a second-felony habitual offender to 55 years at hard labor without benefit of probation or suspension of sentence. For the following reasons, we affirm Defendant's conviction. We vacate his sentence and remand for resentencing...
