Defendant, Alcide Hypolite, was accused of raping his ten-year-old granddaughter, T.J., while she was spending the night at his home.1 He was charged by grand jury indictment with one count of aggravated rape, a violation of La.R.S. 14:42. After a trial by jury, Defendant was found guilty as charged. Defendant was sentenced to the mandatory sentence of life imprisonment without benefit of probation, parole, or suspension...
