We granted the state's application to consider the Fourth Circuit's split-panel decision reversing defendant's conviction and sentence for second degree murder in violation of La.R.S. 14:30.1. State v. Mack, 12-0625 (La.App. 4 Cir. 5/10/13) (unpub'd). For the reasons that follow, the court of appeal's decision is reversed and defendant's conviction and sentence are reinstated.
