The claimant sought workers' compensation benefits after allegedly sustaining injury in a work-related accident. Although the employer disputed whether the injury was work-related, it largely defended the claim pursuant to La.R.S. 23:1081, noting a post-accident drug screen revealed the presence of cocaine and amphetamines in the claimant's system. The workers' compensation judge ruled in favor of the claimant, awarding both compensation benefits and penalties...
