Plaintiff/Appellant, David Sims, appeals a final judgment of the district court granting summary judgment in favor of Defendant/Appellee, Jack in the Box, Inc. ("Jack in the Box"). For the following reasons, we reverse and remand.

BACKGROUND

Mr. Sims and his sister, Sydney Graupmann, both allege they were separately injured on October 28, 2008, within a short period of time in the parking lot of a Quik-Stop/Jack in the Box convenience...
