The defendant, Max Evans, was charged by bill of information with Driving While Intoxicated ("DWI"), third offense, a violation of LSA-R.S. 14:98(D). Following a jury trial, defendant was found guilty as charged and was sentenced to serve five years at hard labor, with three years suspended, and five years of supervised probation upon release from prison.
