The defendant, James Jeffery Simmons, pled guilty to one count of felony theft pursuant to a plea agreement that included an agreed-upon sentence of seven years at hard labor, suspended; three years of active, supervised probation; restitution in the amount of $3,500 to be paid during the first year of probation; a fine of $5,000 and court costs to be paid during the first two years of probation.
