We granted the state's application to consider the judgment of the district court vacating respondent's sentence of death. For the reasons that follow, we reverse the district court and reinstate respondent's capital sentence.

Respondent was convicted of first degree murder and sentenced to death in 1995 for the killing of his wife, Tracie Williams, in what the state urged jurors to find was a murder-for-hire scheme...
