The defendant, James Thomas, was charged by bill of information with one count of vehicular homicide (Count I), a violation of LSA-R.S. 14:32.1, and one count of fourth or subsequent offense driving while intoxicated (Count II), a violation of LSA-R.S. 14:98, and pled not guilty on both counts. The charges were severed and, following a jury trial on Count I, he was found guilty as charged.1<...
