The plaintiff/appellant, Rain CII Carbon LLC ("Rain"), has appealed the judgment of the trial court that granted a dilatory exception of prematurity in favor of the defendants/appellees, ConocoPhillips Company, M.E. Zukerman Calcined Coke Corporation, and M.E. Zukerman Energy Investors Inc. ("Zuckerman") ("hereinafter collectively referred to as "COP" or "defendants").1
