GASKINS, J.

The defendant, Will Jiles, was convicted of DWI-3rd offense in violation of La. R.S. 14:98. He was subsequently sentenced to serve five years' imprisonment at hard labor, without the benefit of probation, parole or suspension of sentence for the first year, and a $2,000 fine. The defendant now appeals. We affirm.
