The State charged the defendant with possession of heroin, and the defendant pled not guilty at arraignment. After the seating of the jury, the State sought but was denied a continuance. The State then issued a nolle prosequi.

The possession of heroin charge was refiled, and the defendant, again, pled not guilty at arraignment. Defendant filed a motion to quash the bill of information...
