This case is the second of two appeals from the same proceeding.1 In this particular appeal, hereafter referred to as "Tobin II," plaintiffs seek review of a trial court judgment sustaining defendants' peremptory exceptions raising the objections of no cause of action and no right of action, and dismissing plaintiffs' petition that sought a permanent injunction and declaratory judgment.
