Defendant, Cornell Patterson, was convicted of theft of goods valued at $500.00 or more, a violation of LSA-R.S. 14:67.10, and sentenced to five years imprisonment at hard labor. After defendant stipulated to a multiple bill alleging that he was a second felony offender, his original sentence was vacated, and he was sentenced to five years imprisonment at hard labor without benefit of probation or suspension of sentence.
