On May 28, 2009, the defendant was indicted for aggravated rape. Subsequent to his indictment, the defendant entered a plea of not guilty. On July 22, 2010, following a two day bench trial, defendant was found guilty of the lesser included offense of sexual battery. The defendant was sentenced to serve twenty-five years at hard labor with credit for time served. This appeal followed.
