Defendant, Harrison Pouncy, Jr., was convicted by a jury of driving while intoxicated ("DWI"), third offense, in violation of La. R.S. 14:98(D). He was subsequently sentenced to the maximum sentence of five years' imprisonment at hard labor. La. R.S. 14:98(D)(1)(a). Defendant now appeals. For the reasons stated herein, the conviction and sentence of Defendant are affirmed.
