CHARLES R. JONES, Judge.
Shawn Simpson appeals his guilty plea and sentence of five years imprisonment, to one count of possession with the intent to distribute marijuana. He contends that the trial court erred by denying his motion to suppress the evidence. We find that Simpson's claim has merit. Thus, we vacate his plea of guilty, grant his motion to suppress evidence, and remand.
