The judgment on review in this appeal is the grant of a summary judgment in favor of defendants/appellees, Cardinal Freight Carrier, Inc. ("Cardinal") and Kendrick Johnson, that dismissed plaintiff/appellant's, Eddie Earl Johnson's, action against them with prejudice. We vacate the judgment and remand.
