The plaintiff brought suit against his son and his son's alleged homeowner's insurer for injuries sustained in a fall at the son's home. The trial court confirmed a default judgment against both defendants. The insurer sought a new trial asserting that it had not been served with the original suit. The trial court denied the motion. The insurer appeals. For the following reasons, we reverse the denial of the motion for new trial and enter judgment granting...
