STATEMENT OF THE CASE

On February 19, 2004, defendant, Kerry J. Curington, and his co-defendant, Clarence Johnson, were indicted and charged with first degree murder of Donell Stipe in violation of LSA-R.S. 14:30. On June 25, 2007, the State amended the charge, as to both defendants, to second degree murder in violation of LSA-R.S. 14:30.1.
