The plaintiff-appellant, General Longshore Workers, Inc. (hereinafter "GLW"), appeals the summary judgment dismissal of its claims against the defendants-appellees, ILA Local 3000 (hereinafter "Local 3000").

We review summary judgments de novo. In this case the burden of proof at trial is not on the moving parties; rather it is on the plaintiffs. Therefore,
