Plaintiff/appellant, O'Neil Kelley ("Kelley"), appeals a judgment of the district court in favor of defendant/appellee, Weber Marine, Incorporated ("Weber"), dismissing Kelley's petition on an Exception of No Cause of Action. This is Kelley's second appeal on the issue.
