The defendant, Michael Cornell Timmons, was convicted of felony theft and subsequently adjudicated a fourth felony offender. On appeal, this court vacated the habitual offender adjudication based on the state's failure to prove the absence of a cleansing period and remanded the matter for further proceedings. State v.
