This matter is before the court on the issue of whether a summary judgment dismissing the possessory action brought by the plaintiff, Marlene E. Richardson, against the defendant, Clifton Garcie, was properly granted by the trial court. For the following reasons, we conclude that genuine issues of material fact remain unresolved, reverse the trial court's grant of summary judgment, and remand the matter for further proceedings.
