FACTS AND PROCEDURAL HISTORY:

The plaintiff, Ms. Colleen Wood (hereinafter "Ms. Wood"), was injured in an automobile accident on March 5, 2002. Ms. Wood argued that the accident caused her to suffer a herniated disc, which was abutting her spinal cord. Ms. Wood's neurosurgeon testified that if Ms. Wood's spondylolisthesis exceeded a certain amount, she would need to undergo a second surgery. An economist, Dr. Kenneth McCoin, testified that...
