On November 2, 2003, the Jefferson Parish District Attorney's Office filed a bill of information charging the defendant, Dave Starr, with simple rape, a violation of LSA-R.S. 14:43. At his arraignment, the defendant pled not guilty. On June 15, 2006, after a two-day trial, a six-person jury found the defendant guilty as charged.
