These two consolidated cases arise out of a rear-end collision on Lake Street in Lake Charles on October 20, 2004. In this case, number 08-566, Anna Plaisance, the guest passenger in the lead vehicle, sued Sally C. Daigle, the driver of the following vehicle, and her insurer, Allstate Insurance Company (Allstate). In case number 08-567, James C.
