These consolidated matters arose out of a motor vehicle accident. Defendant, the State of Louisiana through the Department of Transportation and Development (DOTD), appeals regarding the propriety of the trial court's denial of DOTD's motion for mistrial after the trial court discharged the twelfth juror and continued the jury trial with eleven jurors over DOTD's objection.
