OPINION

This is an appeal from a decision of the Jefferson Circuit Court which granted summary judgment to the Appellee insurer on a claim by an attorney for fees under Kentucky Revised Statute ("KRS") 304.39-070. For reasons that will be set forth below, we affirm the trial court in this case.
