The matter is before us on remand from the Kentucky Supreme Court. Our Supreme Court vacated this Court's opinion rendered on June 7, 2013, and directed that we consider the issue of qualified official immunity in light of its decisions in Marson v. Thomason, 438 S.W.3d 292
