Jeffrey Caniff, Appellant, filed suit against his employer, CSX Transportation, Inc. (CSXT), in Perry Circuit Court pursuant to the Federal Employers' Liability Act (FELA), 45 U.S.C. §§ 51-60. The trial court granted CSXT's motion for summary judgment and Caniff appealed that decision to the Court of Appeals, which affirmed. Caniff sought discretionary review with this Court, which we granted. We now reverse and remand...
