Jeffrey Caniff, Appellant, filed suit against his employer, CSX Transportation, Inc. (CSXT), in Perry Circuit Court pursuant to the Federal Employers' Liability Act (FELA), 45 U.S.C. §§ 51-60. The trial court granted CSXT's motion for summary judgment and Caniff appealed that decision to the Court of Appeals, which affirmed.
