This is an appeal from a decision of the Campbell Circuit Court denying the appellant's Kentucky Rules of Criminal Procedure (RCr) 11.42 motion to vacate. This case was held in abeyance pending the finality in Smith v. Commonwealth, 400 S.W.3d 742 (Ky.2013). That case is now final. Therefore we now consider Teague's appeal.
