The Commonwealth appeals the opinion and order of the Nelson Circuit Court overturning the conviction of Appellee, Louis Robertson, Jr. (hereafter "Robertson") following his ineffective assistance of counsel claim under Kentucky Rules of Criminal Procedure ("RCr") 11.42.
