Cooke has appealed from the Jefferson Circuit Court's trial order and judgment entered on March 23, 2011, following a second jury trial, dismissing his claims against CSX Transportation, Inc., (CSX) for failing to provide a reasonably safe place to work pursuant to the Federal Employers' Liability Act (FELA), 45 U.S.C. §§ 51-60.
