OPINION

CAPERTON, Judge:

The Appellants are representatives of the Estate of Clara Sanders. Sanders was slain by Appellee, James R. Newton, who was convicted on a plea of guilty for reckless homicide. At issue between the parties is a title dispute between the Estate and Newton over the property they held jointly with right of survivorship.
