The State charged Kristina Bishop with a third driving under the influence (DUI) offense, a felony, based upon her having entered into two prior diversion agreements. Bishop moved to dismiss, claiming the State could not rely on a 2002 diversion agreement because she was a minor at that time. The district court denied the motion.
