Because of the way our statutes are drafted, there is often more than one way to commit a crime. For example, if a driver is under the influence of alcohol to a degree that he or she is unable to drive a car safely, he or she is guilty of driving under the influence of alcohol. See K.S.A.2006 Supp. 8-1567(a)(3). In like manner, if the concentration of a driver's blood alcohol exceeds the legal limit within 2 hours of driving, that driver is guilty of driving...
