CAPLINGER, J.

Melvin D. Bryant, Jr., appeals his conviction and sentence for securities fraud in violation of K.S.A.1998 Supp. 17-1253. Bryant argues (1) his right to a statutory right to a speedy trial was violated; (2) the trial court abused its discretion in admitting expert testimony regarding investment fraud schemes; and (3) the trial court erroneously based an aggravated durational departure on the jury's finding of a fiduciary relationship.
