STATEMENT OF THE CASE

Appellant-Defendant, Roche Diagnostics Operation, Inc. (Roche), appeals the trial court's judgment in favor of Appellee-Plaintiff, Marsh Supermarkets, LLC (Marsh).1

We affirm.
