DARDEN, Judge.

STATEMENT OF THE CASE

Rickey D. Whitaker appeals the trial court's order that granted the motion of Travis M. Becker for sanctions and dismissal of Whitaker's complaint for damages.

We affirm in part, reverse in part and remand with instructions.
