OPINION

RILEY, Judge.

STATEMENT OF THE CASE

Appellant-Defendant, Clint Beldon (Beldon), appeals his conviction for operating a motor vehicle while intoxicated, as a Class D felony, Ind.Code § 9-30-5-3, and the trial court's finding that he is a habitual substance offender for sentencing purposes under I.C. § 35-50-2-10.

We affirm in part, reverse in part, and remand with instructions.
