JUSTICE McLAREN delivered the judgment of the court, with opinion.

¶ 1 Defendant, Timothy D. Kane, appeals from the trial court's orders dismissing his amended petition for relief from judgment, which was brought pursuant to section 2-1401 of the Code of Civil Procedure (Code) (735 ILCS 5/2-1401 (West 2010)), and his petition for postconviction relief, brought pursuant to the Post-Conviction Hearing Act (Act) (725 ILCS 5/122-1 et seq.
