¶ 1 Plaintiff Eleanor Ballog appeals from the circuit court's grant of summary judgment to defendant City of Chicago (the City) in her suit charging the City with negligence. The plaintiff fractured her foot when she tripped as she stepped from the portion of the street that had been excavated, refilled with concrete, but not resurfaced.
