¶ 1 In September 2009, plaintiff, Lynda S. Howle, sued defendants, Aqua Illinois, Inc. (Aqua), and Robert Chitwood. Howle alleged, in part, that Aqua was liable under (1) section 16 of the Animal Control Act (Act) (510 ILCS 5/16 (West 2010)) (count II) and (2) the common-law tort of negligence (count IV) for injuries she sustained when Chitwood's dog "viciously attacked" her...
