In October 2003, plaintiff, James Hurlbert, was arrested for driving under the influence of alcohol (625 ILCS 5/11-501 (West 2004)). Thereafter, plaintiff filed a petition to rescind the statutory summary suspension of his driver's license (625 ILCS 5/2-118.1(b) (West 2004)).
