Plaintiff Pekin Insurance Co. (Pekin) filed this declaratory judgment action and appeals the trial court's denial of its motion for summary judgment and granting of Roszak/ADC, LLC's (Roszak) cross-motion for summary judgment, finding that Pekin owes Roszak a duty to defend. 735 ILCS 5/2-1005 (West 2008). In the underlying action, Deirdre Hastings had filed suit against Roszak, among others, alleging negligence...
