In December 2004, defendant, John C. Elder, was charged with burglary (720 ILCS 5/19-1 (West 2004)) and theft (720 ILCS 5/16-1 (West 2004)). In January 2008, a jury convicted defendant of theft but acquitted him on the burglary charge. He was sentenced to 10 years' imprisonment with credit for 362 days' time served.
