This appeal arises from the grant of a motion for judgment on the pleadings in a quiet-title action. This is the third appeal pursued by Byron Thomason (deceased) and his `wife Marilynn Thomason (Thomasons) against the brothers Terrence Bagley and John Bagley (the Bagleys).
